COOKIES AND OTHER TECHNOLOGIES

We, and our service providers and partners, use cookies, web beacons, and other technologies (collectively, “technologies”) to operate our website and to help collect and transmit data, including identifiers, device information, commercial information, Internet and network activity, device information, inferences, and geolocation data.

What are cookies and other technologies?

Cookies are small text files placed by a website and stored by your browser on your device. A cookie can later be read when your browser connects to a web server in the same domain that placed the cookie. The text in a cookie contains a string of numbers and letters that may uniquely identify your device and can contain other information as well. This allows the web server to recognize your browser over time, each time it connects to that web server.

Web beacons (also called clear GIFs or pixels) are electronic images that are contained within a website or email. When your browser opens a webpage or email that contains a web beacon, it automatically connects to the web server that hosts the image (typically operated by a third party). This allows that web server to log information about your device and to set and read its own cookies. In the same way, third-party content on our websites (such as embedded videos, plug-ins, or ads) results in your browser connecting to the third-party web server that hosts that content. We also include web beacons in our email messages or newsletters to tell us if you open and act on them.

How do we and our partners use cookies and other technologies?

Our website uses these technologies, and the data they enable us and our service providers and partners to collect, to store your preferences and settings, enable you to sign-in, analyze how our website performs, track your interaction with the website, deliver and tailor interest-based advertising, combat fraud, and to help with other business purposes.

We and our service providers and partners may combine the personal information collected via technologies on our website with personal information about your online activities over time and across different websites or online services. For more information about the service providers and partners that collect personal information using technologies on our website, please see the “Our Disclosure of Personal information” section of this policy.

See the “Choice and Control of Personal Information” section below for details about choices you may have.

We disclose personal information consistent with your consents and requests, or when we deem it helpful or necessary to complete your transactions or provide the services you have requested or authorized. In addition, we disclose each of the categories of personal information described above, to the types of entities described below, including for the following business purposes:

  • Service providers. We provide personal information to vendors or agents working on our behalf for the purposes described in this policy. These may include auditors, consultants, lawyers, professional services companies, companies we’ve hired to assist us with analytics, provide customer service support, assist in protecting and securing our systems and services, and others.
  • Fulfillment partners. We provide personal information to fulfillment partners and delivery services to fulfill orders.

When you provide payment data, for example to make a purchase, we will disclose payment and transactional data to banks, payment processors, and other entities as necessary for payment processing, fraud prevention, credit risk reduction, analytics, or other related financial services.
  • Affiliates. We enable access to personal information across our subsidiaries, affiliates, and related companies, for example, where we share common data systems or where access helps us to provide our services and operate our business.

  • Analytics and advertising partners. Analytics companies, advertising companies, third-party social media platforms, and other partners also collect personal information through our website as described in the “Cookies and Other Technologies” section of this policy. We and these companies and partners may also disclose this data to other companies, including for advertising and analytics purposes.  These companies and partners may use and combine personal information across multiple sites to display targeted advertisements.  Some of these disclosures may be considered a “sale” or “sharing” of personal information as defined under U.S. state privacy laws.   Please see the “Choice and Control” section below for details on how to opt out.
  • Security, safety, and protecting rights. We will disclose personal information if we believe it is necessary to:
    • protect our customers and others, for example to prevent spam or attempts to commit fraud, or to help prevent the loss of life or serious injury of anyone;
    • maintain the safety, security, functionality, and integrity of our site, services, and other assets or business; or
    • protect the rights or property of ourselves or others, including enforcing our agreements, terms, and policies.

Please note that some of our services also include integrations, references, or links to services provided by third parties whose privacy practices differ from ours. If you provide personal information to any of those third parties, or allow us to disclose personal information with them, that data is governed by their privacy policy.

CHOICE AND CONTROL OF PERSONAL INFORMATION

We provide a variety of ways for you to control the personal information we hold about you, including choices about how we use that data. In some jurisdictions, these controls and choices may be enforceable as rights under applicable law.

Access, correction, and deletion.  If you reside in a jurisdiction that that affords rights to access (or to know), correct, or delete personal information, and you wish to access, correct, or delete personal information about you that we hold, you may email us at info@BettaBot.com. The right to access (or to know) may include the right to confirm that we are processing personal information about you, to request access to or a copy of the personal information we have about you, to know the third parties that we have disclosed (or sold) personal information to, and/or to know additional information about how we process personal information about you.

Communications preferences. If you receive promotional communications from us by email, and would like to unsubscribe, you can do so by following the directions in that message to unsubscribe.  You cannot unsubscribe from certain informational communications.

Do Not Sell or Share My Personal Information. Some U.S. state privacy laws define “sell” and “share” very broadly, and some of our data disclosures described in this policy may be considered a “sale” or “sharing” under those definitions. In particular, advertising partners we work with for targeted advertising purposes may collect or receive personal information such as identifiers, device information, commercial information, Internet and network activity, device information, inferences, and geolocation data, through technologies on our website, including as further described in the “Cookies and Other Technologies” section above.

If you do not wish for us to “sell” personal information, or “share” personal information for targeted advertising purposes, you can make your request to opt-out by email at info@BettaBot.com, and by following the instructions below for opting out of having personal data we collect from you used for targeted advertising. You should take both of these actions when making your request so that it can be honored both for personal information we collect about you, and for personal information that is collected automatically (such as via technologies).

If you opt-out using these choices, we will take steps to stop disclosing personal information in ways that are considered a “sale” or “sharing” (for targeted advertising) for which opt-out rights are required under applicable law. However, we will continue to disclose personal data to service providers and others as allowed by applicable law. We do not knowingly sell or share (for targeted advertising) personal information of minors under 16 years of age.

Targeted advertising. To opt-out from having personal information we collect from you used for targeted advertising, you can use the:

  • Choices available through our website here; or
  • Global Privacy Control (“GPC”) setting in a web browser or browser extension, which advertising-related cookies on our website may honor. Web browsers and browser extensions that support the GPC setting may send a signal to the websites you visit indicating your choice to opt-out from “sales” of personal data and/or targeted advertising. When we detect such a signal, we will make reasonable efforts to respect your choices as communicated by the GPC signal where it is recognized by applicable law as a valid opt-out preference signal.

All of the options in this section are specific to the device or browser you are using. If you access our services from other devices or browsers, take these actions from those devices and browsers as well.

Some browsers include a "Do Not Track" (DNT) setting that can send websites a signal indicating you do not wish to be tracked. Unlike the GPC described above, there is not a common understanding of how to interpret the DNT signal; therefore, our websites do not respond to browser DNT signals.

If you make a request to access, correct, or delete personal information, where permitted by applicable law, we may request information needed to verify your identity.  For example, we may require you to send us your request from the email address you have used in connection with our services, or to confirm information we have about your purchase or order.  We will not be able to honor your request if we cannot verify your identity.

Only you, or someone legally authorized to act on your behalf and with written permission, may make a verifiable consumer request related to your personal information.  You may designate, in writing or through a power of attorney, an authorized agent to make requests on your behalf where permitted by applicable law. Before accepting such a request from an agent, we will require the agent to provide proof you have authorized it to act on your behalf, and we may need you to verify your identity directly with us.

If you send us a request to exercise your rights or these choices, to the extent permitted by applicable law, we may decline requests in certain cases. For example, we may decline requests where granting the request would be prohibited by law, could adversely affect the privacy or other rights of another person, would reveal a trade secret or other confidential information, or would interfere with a legal or business obligation that requires retention or use of the data. Further, we may decline a request where we are unable to authenticate you as the person to whom the data relates, the request is unreasonable or excessive, or where otherwise permitted by applicable law. If you receive a response from us informing you that we have declined your request, in whole or in part, you may appeal that decision by submitting your appeal using the contact method described at the bottom of this privacy policy.

We will not discriminate against you for exercising any of your privacy rights and we will not deny you goods or services, charge you a different price, or provide you with a lesser quality of goods or services if you exercise any of those rights.

RETENTION OF PERSONAL INFORMATION

We retain personal information for as long as necessary to provide the services and fulfill the transactions you have requested, comply with our legal obligations, resolve disputes, enforce our agreements, and for other legitimate and lawful business purposes. Because these needs can vary for different data types in the context of different services, actual retention periods can vary significantly based on criteria such as reasonable consumer expectations, consent, the sensitivity of the data, the availability of automated controls that enable users to delete data, and our legal or contractual obligations.

LOCATION OF PERSONAL INFORMATION

The personal information we collect may be stored and processed in your country or region, or in any other country where we or our affiliates, subsidiaries, or service providers process data, some of which may have laws that offer different levels of data protection than the country in which you reside. For example, we may process personal information in the United States of America.

SECURITY OF PERSONAL INFORMATION

We aim to protect your personal information through what we believe to be commercially reasonable security measures.

However, please also remember that we cannot guarantee that the internet itself is 100% secure. The transmission of personal information to and from our website is at your own risk.

CHILDREN AND MINORS

We do not knowingly collect personal information of any user aged 13 or under on our website.  If a user or their parent or legal guardian believes we have collected any personal information of a minor (under the age of 18), please contact us at info@BettaBot.com.

OTHER INFORMATION FOR CALIFORNIA RESIDENTS

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with our website, you have the right to request the removal of unwanted data that you publicly post on the website. To request the removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will take steps so that the information is not publicly displayed on the website, but please be aware that the data may not be completely or comprehensively removed from our systems.

We do not use or disclose sensitive personal information in a way that requires us to offer you the right to limit use or disclosure of sensitive personal information under California law.

We may offer you certain financial incentives that can result in different prices, rates, or quality levels. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time. The financial incentives offered on our site from time to time in exchange for consumer data (typically a promotional discount in exchange for an email address or for joining a member rewards program) are commonly percentage discount codes to be applied to a single purchase. The discounts may result in a range of savings to the consumer, depending on the details of the purchase, and are primarily offered to consumers as a way of introducing them to our products and services, following which we are confident the quality of our products and service will turn a first-time purchaser into a loyal and delighted long term BettaBot consumer. Incentives are not directly tied to, or exclusively based upon, a set value of any individual element of consumer data.  Discounts may also be affected by factors such as performance targets, geographic location, seasonality and market trends.

CHANGES TO THIS PRIVACY POLICY

We will update this privacy policy when necessary to reflect changes in our services, how we use personal information, or the applicable law. When we post changes to the policy, we will revise the "Last Updated" date at the top of the policy. If we make material changes to the policy, we will provide notice as required by applicable law.
